This agreement applies as between you, the User of this Website and UAB Advansis LT, the owner(s) of this Website. Your agreement to comply with and be bound by Clauses 1, 2, 4 – 11 and 15 – 25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 3 and 12 – 14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:
  • "Account": means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and/or any communications System on the Website;
  • "Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
  • "Facilities": means collectively any online facilities, tools, services or information that UAB Advansis LT makes available through the Website either now or in the future;
  • "Services": means the services available to you through this Website, specifically use of the UAB Advansis LT proprietary e-learning platform;
  • "Payment Information": means any details required for the purchase of Services from this Website. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;
  • "Premises": Means Our place(s) of business located at Perkunkiemio g. 19, Vilnius, LT-12120;
  • "System": means any online communications infrastructure that UAB Advansis LT makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
  • "User" / "Users": means any third party that accesses the Website and is not employed by UAB Advansis LT Ltd and acting in the course of their employment;
  • "Website": means the website that you are currently using (www.learnmyo.lt) and any sub-domains of this site (e.g. subdomain.learnmyo.com) unless expressly excluded by their own terms and conditions; and
  • "We/Us/Our": means UAB Advansis LT, a company incorporated in Lithuania with Company registration Number 303127696, located at Perkunkiemio g. 19, Vilnius, LT-12120.

2. Age Restrictions

Persons under the age of 18 should use this Website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

3. Business Customers

These Terms and Conditions also apply to customers procuring Services in the course of business.

4. Intellectual Property

  • 4.1 Subject to the exceptions in Clause 5 of these Terms and Conditions, all Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of UAB Advansis LT, our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable European Union and International intellectual property and other laws.
  • 4.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given Our express written permission to do so.

5. Third Party Intellectual Property

  • 5.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.
  • 5.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on the Website or unless given express written permission to do so by the relevant manufacturer or supplier.

6. Fair Use of Intellectual Property

Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

9. Use of Communications Facilities

  • 9.1 When using any System on the Website you should do so in accordance with the following rules. Failure to comply with these rules may result in your Account being suspended or closed:
  • 9.1.1 You must not use obscene or vulgar language;
  • 9.1.2 You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
  • 9.1.3 You must not submit Content that is intended to promote or incite violence;
  • 9.1.4 It is advised that submissions are made using the English language as We may be unable to respond to enquiries submitted in any other languages;
  • 9.1.5 The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws;
  • 9.1.6 You must not impersonate other people, particularly employees and representatives of UAB Advansis LT or Our affiliates; and
  • 9.1.7 You must not use Our System for unauthorised mass-communication such as "spam" or "junk mail".
  • 9.2 You acknowledge that UAB Advansis LT reserves the right to monitor any and all communications made to Us or using Our System.
  • 9.3 You acknowledge that UAB Advansis LT may retain copies of any and all communications made to Us or using Our System.
  • 9.4 You acknowledge that any information you send to Us through Our System may be modified by Us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon Our use of such information must be communicated to Us in advance and We reserve the right to reject such terms and associated information.

10. Accounts

  • 10.1 In order to procure Services on this Website and to use certain other parts of the System, you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as We may not require payment information until you wish to make a purchase. By continuing to use this Websiteyou represent and warrant that:
  • 10.1.1 all information you submit is accurate and truthful;
  • 10.1.2 you have permission to submit Payment Information where permission may be required; and
  • 10.1.3 you will keep this information accurate and up-to-date. Your creation of an Account is further affirmation of your representation and warranty.
  • 10.2 It is recommended that you do not share your Account details, particularly your username and password. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
  • 10.3 If you have reason to believe that your Account details have been obtained by another person without consent, you should contact Us immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending. Please be aware that orders or payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying Us of the unauthorised nature of the order or payment then you shall be charged for the period from the commencement of the provision of services until the date you notified us and may be charged for a billing cycle of one month.
  • 10.4 When choosing your username you are required to adhere to the terms set out above in Clause 9. Any failure to do so could result in the suspension and/or deletion of your Account.

11. Termination and Cancellation of Accounts

  • 11.1 Either UAB Advansis LT or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.
  • 11.2 If We terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

12. Services, Pricing and Availability

  • 12.1 Whilst every effort has been made to ensure that all general descriptions of Services available from UAB Advansis LT correspond to the actual Services that will be provided to you, We are not responsible for any variations from these descriptions as the exact nature of the Services may vary depending on your individual requirements and circumstances. This does not exclude Our liability for mistakes due to negligence on Our part and refers only to variations of the correct Services, not different Services altogether. Please refer to sub-Clause 13.8 for incorrect Services.
  • 12.2 Where appropriate, you may be required to select the required Plan of Services.
  • 12.3 We neither represent nor warrant that such Services will be available at all times and cannot necessarily confirm availability until confirming your Order. Availability indications are not provided on the Website.
  • 12.4 All pricing information on the Website is correct at the time of going online. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary.
  • 12.5 In the event that prices are changed during the period between an order being placed for Services and Us processing that order and taking payment, then the price that was valid at the time of the order shall be used.

13. Orders and Provision of Services

  • 13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may, at Our sole discretion, accept. Our acceptance is indicated by Us sending to you an order confirmation email. Only once We have sent you an order confirmation email will there be a binding contract between UAB Advansis LT and you.
  • 13.2 Order confirmations under sub-Clause 13.1 will be sent to you before the Services begin and shall contain the following information:
  • 13.2.1 Confirmation of the Services ordered including full details of the main characteristics of those Services;
  • 13.2.2 Fully itemised pricing for the Services ordered including, where appropriate, taxes, delivery and other additional charges;
  • 13.2.3 Relevant times and dates for the provision of the Services;
  • 13.2.4 User credentials and relevant information for accessing those services.
  • 13.3 If We, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, any sums paid by you in relation to that order will be refunded within 14 calendar days.
  • 13.4 Payment for the Services shall be taken via your chosen payment method, immediately for any setup fee that corresponds to the service plan you purchased and at the same day of each subsequent month (“billing cycle”) for charges accrued during the previous month (“billing cycle”) AND/OR as indicated in the order confirmation you received.
  • 13.5 We aim to fulfill your Order within 2-3 working days or if not, within a reasonable period following your Order, unless there are exceptional circumstances. If we cannot fulfill your Order within a reasonable period, we will inform you at the time you place the Order by a note on the relevant web page or by contacting you directly after you place your Order. Time is not of the essence of the Contract, which means we will aim to fulfill your Order within any agreed timescales but this is not an essential term of the Contract and we will not be liable to you if we do not do so. If the Services are to begin within 14 calendar days of Our acceptance of your order, at your express request, you will be required to expressly acknowledge that your statutory cancellation rights, detailed below in Clause 14, will be affected.
  • 13.6 UAB Advansis LT shall use all Our reasonable endeavours to provide the Services with reasonable skill and care, commensurate with best trade practice.
  • 13.7 In the event that Services are provided that are not in conformity with your order and thus incorrect, you should contact Us immediately to inform Us of the mistake. We will ensure that any necessary corrections are made within five (5) working days.
  • Additional terms and conditions may apply to the provision of certain Services. You will be asked to read and confirm your acceptance of any such terms and conditions when completing your Order.
  • 13.8 UAB Advansis LT provides technical support via our online support forum and/or phone. UAB Advansis LT makes every effort possible to respond in a timely manner but we do not guarantee a particular response time.

14. Cancellation of Orders and Services

We want you to be completely satisfied with the Products or Services you order from UAB Advansis LT. If you need to speak to us about your Order, then please contact customer care by email at info@learnmyo.lt or write to us at our address (see section 1 above). You may cancel an Order that we have accepted or cancel the Contract. If any Specific Terms accompanying the Service contain terms about cancelling the Service, the cancellation policy in the Specific Terms will apply.
  • 14.1 If you are a consumer based within the European Union, you have a statutory right to a “cooling off” period. This period begins once your order is confirmed and the contract between UAB Advansis LT and you is formed and ends at the end of 14 calendar days after that date. If you change your mind about the Services within this period and wish to cancel your order, please inform Us immediately using the following email: info@learnmyo.lt. Your right to cancel during the cooling off period is subject to the provisions of sub-Clause 14.2.
  • 14.2 As specified in sub-Clause 13.6, if the Services are to begin within the cooling off period you are required to make an express request to that effect. By requesting that the Services begin within the 14 calendar day cooling off period you acknowledge and agree to the following:
  • 14.2.1 If the Services are fully performed within the 14 calendar day cooling off period, you will lose your right to cancel after the Services are complete.
  • 14.2.2 If you cancel the Services after provision has begun but is not yet complete you will still be required to pay for the Services supplied up until the point at which you inform Us that you wish to cancel. The amount due shall be calculated in proportion to the full price of the Services and the actual Services already provided. Any sums that have already been paid for the Services shall be refunded subject to deductions calculated in accordance with the foregoing. Refunds, where applicable, will be issued within 5 working days and in any event no later than 14 calendar days after you inform Us that you wish to cancel.
  • 14.3 Cancellation of Services after the 14-calendar-day cooling-off period has elapsed shall not result in any refund of payments made prior to cancellation. You acknowledge and agree that no refunds will be issued for any purchases made under this Agreement, regardless of the circumstances.
  • 14.4 The subscription requires a minimum commitment of one month. Payments made for the current billing cycle are non-refundable. Cancellation requests will take effect at the conclusion of the current monthly billing cycle, ensuring no additional charges are incurred thereafter.

15. Privacy

Use of the Website is also governed by Our Privacy Policy (www.learnmyo.lt/privacy) which is incorporated into these Terms and Conditions by this reference. To view the Privacy Policy, please click on the link above.

16. How We Use Your Personal Information (Data Protection)

  • 16.1 All personal information that We may collect (including, but not limited to, your name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and your rights under that Act.
  • 16.2 We may use your personal information to:
  • 16.2.1 Provide Our Services to you;
  • 16.2.2 Process your payment for the Services; and
  • 16.2.3 Inform you of new products and services available from Us. You may request that We stop sending you this information at any time.
  • 16.3 In certain circumstances (if, for example, you wish to purchase Services on credit), and with your consent, We may pass your personal information on to credit reference agencies. These agencies are also bound by the Data Protection Act 1998 and should use and hold your personal information accordingly.
  • 16.4 We will not pass on your personal information to any other third parties without first obtaining your express permission.
  • 16.5 UAB Advansis LT is not intended to store, process or transmit Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA) or any similar healthcare privacy regulations. Users are expressly instructed not to include, upload or transmit any medical diagnoses, treatment notes, identifiable health data or other PHI when labeling or describing programs, uploading materials or using any part of the Platform. The Services are provided solely for educational and general wellness purposes and are not a substitute for professional medical advice, diagnosis or treatment.

17. Disclaimers

  • 17.1 We make no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.
  • 17.2 No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.
  • 17.3 Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, you are strongly advised to take responsibility for your own internet security, that of your personal details and your computers.

18. Changes to the Facilities and these Terms and Conditions

We reserve the right to change the Website, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Website following the changes. If We are required to make any changes to these Terms and Conditions by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

19. Availability of the Website

  • 19.1 The Website is provided “as is” and on an “as available” basis. UAB Advansis LT uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
  • 19.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

20. Limitation of Liability

  • 20.1 To the maximum extent permitted by law, We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. You should be aware that you use the Website and its Content at your own risk.
  • 20.2 Nothing in these Terms and Conditions excludes or restricts .
  • 20.3 Nothing in these Terms and Conditions excludes or restricts UAB Advansis LT's liability for any direct or indirect loss or damage arising out of the incorrect provision of Services or out of reliance on incorrect information included on the Website.
  • 20.4 In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal.

21. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

22. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

23. Third Party Rights

Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and UAB Advansis LT.

24. Communications

  • 24.1 All notices / communications shall be given to Us either by post to Our Premises (see address above) or by email to info@learnmyo.lt. Such notice will be deemed received 7 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
  • 24.2 We may from time to time, if you opt to receive it, send you information about Our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from Us.

25. Law and Jurisdiction

These Terms and Conditions and the relationship between you and UAB Advansis LT shall be governed by and construed in accordance with the laws of United States and UAB Advansis LT and you agree to submit to the exclusive jurisdiction of the courts of the United States.
Ši sutartis taikoma jums, kaip šios Svetainės naudotojui, ir UAB Advansis LT, šios Svetainės savininkui (-ams). Laikoma, kad jūsų sutikimas laikytis ir būti saistomam šių Naudojimosi sąlygų 1, 2, 4–11 ir 15–25 punktų įsigalioja nuo jūsų pirmojo naudojimosi Svetaine momento. 3 ir 12–14 punktai taikomi tik Paslaugų pardavimui. Jei nesutinkate laikytis šių Naudojimosi sąlygų, privalote nedelsdami nutraukti naudojimąsi Svetaine.
Jokia šios Svetainės dalis nėra laikoma sutartiniu pasiūlymu, galinčiu būti priimtu. Jūsų pateiktas užsakymas laikomas sutartiniu pasiūlymu, o mūsų sutikimas su tokiu pasiūlymu laikomas įvykusiu nuo to momento, kai jums išsiunčiame patvirtinimo el. laišką, kuriame nurodoma, kad jūsų užsakymas buvo priimtas.

1. Sąvokos ir jų paaiškinimas

Šioje Sutartyje toliau nurodytos sąvokos turi šias reikšmes:
„Paskyra“ – visi naudotojo asmens duomenys, Mokėjimo informacija ir prisijungimo duomenys, naudojami prieigai prie Mokamo turinio ir (arba) bet kurios komunikacijos Sistemos Svetainėje;
„Turinys“ – bet koks tekstas, grafika, vaizdai, garso ar vaizdo įrašai, programinė įranga, duomenų rinkiniai ar kita informacija, kuri gali būti saugoma kompiuterinėje sistemoje ir kuri yra pateikiama šioje Svetainėje arba sudaro jos dalį;
„Priemonės“ (Facilities) – visos internetinės priemonės, įrankiai, paslaugos ar informacija, kurias UAB Advansis LT teikia per Svetainę dabar arba ateityje;
„Paslaugos“ – paslaugos, prieinamos jums per šią Svetainę, įskaitant naudojimąsi UAB Advansis LT nuosava e. mokymosi platforma;
„Mokėjimo informacija“ – bet kokie duomenys, reikalingi Paslaugų įsigijimui per šią Svetainę, įskaitant (bet neapsiribojant) kredito ar debeto kortelių numerius, banko sąskaitų numerius ir mokėjimo kodus;
„Patalpos“ – mūsų veiklos vieta (-os), esanti (-os) adresu Perkūnkiemio g. 19, Vilnius, LT-12120;
„Sistema“ – bet kokia internetinė komunikacijos infrastruktūra, kurią UAB Advansis LT teikia per Svetainę dabar arba ateityje, įskaitant (bet neapsiribojant) internetinį el. paštą, pranešimų lentas, tiesioginių pokalbių funkcijas ir el. pašto nuorodas;
„Naudotojas“ / „Naudotojai“ – bet kuris trečiasis asmuo, kuris naudojasi Svetaine ir nėra UAB Advansis LT darbuotojas, veikiantis savo darbo pareigų vykdymo metu;
„Svetainė“ – interneto svetainė, kuria šiuo metu naudojatės (www.learnmyo.lt), ir visi jos subdomenai (pvz., subdomain.learnmyo.com), nebent jie aiškiai reglamentuojami atskiromis sąlygomis;
„Mes / Mums / Mūsų“ – UAB Advansis LT, Lietuvoje įsteigta bendrovė, kurios įmonės kodas 303127696, registruota adresu Perkūnkiemio g. 19, Vilnius, LT-12120.

2. Amžiaus apribojimai

Asmenys, jaunesni nei 18 metų, gali naudotis šia Svetaine tik prižiūrimi suaugusiojo. Mokėjimo informacija turi būti pateikiama suaugusiojo arba gavus jo leidimą.

3. Verslo klientai

Šios Naudojimosi sąlygos taip pat taikomos klientams, įsigyjantiems Paslaugas vykdant verslo veiklą.

4. Intelektinė nuosavybė

4.1 Išskyrus šių Naudojimosi sąlygų 5 punkte numatytas išimtis, visas Svetainėje pateikiamas Turinys, jei jo neįkėlė Naudotojai, įskaitant, bet neapsiribojant, tekstą, grafiką, logotipus, piktogramas, vaizdus, garso įrašus, vaizdo įrašus, duomenų rinkinius, puslapio išdėstymą, pagrindinį kodą ir programinę įrangą, yra UAB Advansis LT, jos susijusių bendrovių arba kitų atitinkamų trečiųjų šalių nuosavybė. Tęsdami naudojimąsi Svetaine, jūs pripažįstate, kad toks turinys yra saugomas pagal galiojančius Europos Sąjungos ir tarptautinius intelektinės nuosavybės bei kitus teisės aktus.
4.2 Vadovaujantis 6 punktu, jums draudžiama atkurti, kopijuoti, platinti, saugoti ar bet kokiu kitu būdu pakartotinai naudoti Svetainėje esantį Turinį, nebent tai aiškiai nurodyta Svetainėje arba gavus aiškų mūsų rašytinį sutikimą.

5. Trečiųjų šalių intelektinė nuosavybė

5.1 Jei aiškiai nenurodyta kitaip, visos intelektinės nuosavybės teisės, įskaitant, bet neapsiribojant, autorių teises ir prekių ženklus, susijusios su produktų vaizdais ir aprašymais, priklauso atitinkamų produktų gamintojams arba platintojams.
5.2 Vadovaujantis 6 punktu, jums draudžiama atkurti, kopijuoti, platinti, saugoti ar bet kokiu kitu būdu pakartotinai naudoti tokį turinį, nebent tai aiškiai nurodyta Svetainėje arba gavus aiškų rašytinį atitinkamo gamintojo ar tiekėjo sutikimą.

6. Sąžiningas intelektinės nuosavybės naudojimas:

Svetainėje esantis turinys gali būti pakartotinai naudojamas be rašytinio leidimo tais atvejais, kai taikomos išimtys, numatytos 1988 m. Autorių teisių, dizaino ir patentų įstatymo (Copyright, Designs and Patents Act 1988) III skyriuje.

9. Komunikacijos priemonių naudojimas

9.1 Naudodamiesi bet kuria Svetainei priklausančia Sistema, privalote laikytis toliau nurodytų taisyklių. Nesilaikant šių taisyklių, jūsų Paskyra gali būti laikinai sustabdyta arba panaikinta.
9.1.1 Draudžiama vartoti nepadorią ar vulgarią kalbą;
9.1.2 Draudžiama pateikti Turinį, kuris yra neteisėtas ar kitaip nepriimtinas. Tai apima, bet neapsiriboja, įžeidžiančiu, grasinančiu, priekabiaujančiu, šmeižikišku, diskriminuojančiu dėl amžiaus, lyties ar rasės Turiniu;
9.1.3 Draudžiama pateikti Turinį, kuriuo siekiama skatinti ar kurstyti smurtą;
9.1.4 Rekomenduojama pateikti užklausas anglų kalba, nes galime neturėti galimybės atsakyti į užklausas, pateiktas kitomis kalbomis;
9.1.5 Jūsų naudojami tapatybės nurodymo būdai neturi pažeisti šių Naudojimosi sąlygų ar taikomų teisės aktų;
9.1.6 Draudžiama apsimesti kitais asmenimis, ypač UAB Advansis LT ar mūsų susijusių bendrovių darbuotojais ar atstovais;
9.1.7 Draudžiama naudoti mūsų Sistemas neautorizuotai masinei komunikacijai, tokiai kaip „šlamštas“ (angl. spam) ar nepageidaujami laiškai (angl. junk mail).
9.2 Jūs patvirtinate, kad UAB Advansis LT pasilieka teisę stebėti bet kokią ir visą komunikaciją, siunčiamą mums arba vykdomą naudojantis mūsų Sistemomis.
9.3 Jūs patvirtinate, kad UAB Advansis LT gali saugoti bet kokios ir visos komunikacijos, siunčiamos mums arba vykdomos naudojantis mūsų Sistemomis, kopijas.
9.4 Jūs patvirtinate, kad bet kokia informacija, kurią mums siunčiate per mūsų Sistemas, gali būti mūsų bet kokiu būdu keičiama, ir jūs atsisakote savo moralinės teisės būti nurodytu tokios informacijos autoriumi. Bet kokie apribojimai, kuriuos pageidautumėte taikyti mūsų naudojimuisi tokia informacija, turi būti mums aiškiai nurodyti iš anksto, o mes pasiliekame teisę tokių sąlygų ir susijusios informacijos nepriimti.

10. Paskyros

10.1 Norėdami įsigyti Paslaugas šioje Svetainėje ir naudotis tam tikromis kitomis Sistemos dalimis, privalote susikurti Paskyrą. Paskyroje bus saugomi tam tikri asmens duomenys ir Mokėjimo informacija, kuri gali skirtis priklausomai nuo jūsų naudojimosi Svetaine, nes mokėjimo informacijos gali būti nereikalaujama tol, kol nuspręsite atlikti pirkimą. Tęsdami naudojimąsi šia Svetaine, jūs patvirtinate ir garantuojate, kad:
10.1.1 visa jūsų pateikiama informacija yra tiksli ir teisinga;
10.1.2 turite teisę pateikti Mokėjimo informaciją tais atvejais, kai toks leidimas yra reikalingas;
10.1.3 įsipareigojate užtikrinti, kad ši informacija būtų tiksli ir nuolat atnaujinama. Paskyros sukūrimas taip pat patvirtina jūsų pateiktus pareiškimus ir garantijas.
10.2 Rekomenduojame nesidalyti savo Paskyros duomenimis, ypač naudotojo vardu ir slaptažodžiu. Mes neprisiimame jokios atsakomybės už nuostolius ar žalą, patirtus dėl to, kad jūs patys pasidalijote savo Paskyros duomenimis. Jei naudojatės bendru kompiuteriu, rekomenduojame neišsaugoti savo Paskyros duomenų interneto naršyklėje.
10.3 Jei turite pagrindo manyti, kad jūsų Paskyros duomenys buvo gauti kito asmens be jūsų sutikimo, privalote nedelsdami susisiekti su mumis, kad galėtume sustabdyti jūsų Paskyrą ir atšaukti bet kokius neautorizuotus užsakymus ar mokėjimus, kurie gali būti vykdomi. Atkreipiame dėmesį, kad užsakymai ar mokėjimai gali būti atšaukti tik iki Paslaugų teikimo pradžios. Jei neautorizuotas Paslaugų teikimas pradedamas iki tol, kol mus informuojate apie neautorizuotą užsakymo ar mokėjimo pobūdį, jums bus taikomas mokestis už laikotarpį nuo Paslaugų teikimo pradžios iki datos, kurią mus informavote, ir papildomai gali būti taikomas mokestis už vieno mėnesio atsiskaitymo laikotarpį.
10.4 Renkantis naudotojo vardą, privalote laikytis aukščiau 9 punkte nustatytų reikalavimų. Jų nesilaikymas gali lemti jūsų Paskyros sustabdymą ir (arba) panaikinimą.

11. Paskyrų nutraukimas ir atšaukimas

11.1 Tiek UAB Advansis LT, tiek jūs turite teisę nutraukti savo Paskyrą. Jei mes nutraukiame jūsų Paskyrą, apie tai būsite informuoti el. paštu ir jums bus pateiktas Paskyros nutraukimo paaiškinimas. Nepaisant to, mes pasiliekame teisę nutraukti Paskyrą ir nepateikdami nutraukimo priežasčių.
11.2 Jei mes nutraukiame jūsų Paskyrą, visi tuo metu galiojantys ar laukiantys užsakymai ar mokėjimai, susiję su jūsų Paskyra, bus atšaukti, o Paslaugų teikimas nebus pradėtas.

12. Paslaugos, kainodara ir prieinamumas

12.1 Nors buvo dedamos visos pastangos užtikrinti, kad bendrieji UAB Advansis LT teikiamų Paslaugų aprašymai atitiktų faktines jums teikiamas Paslaugas, mes neatsakome už galimus netikslumus, kadangi tikslus Paslaugų pobūdis gali skirtis priklausomai nuo jūsų individualių poreikių ir aplinkybių. Tai nepanaikina mūsų atsakomybės už klaidas, atsiradusias dėl mūsų aplaidumo, ir taikoma tik tinkamų Paslaugų variacijoms, o ne visiškai kitokių Paslaugų teikimui. Dėl neteisingai suteiktų Paslaugų prašome vadovautis 13.8 punktu.
12.2 Kur tai taikoma, jums gali būti reikalaujama pasirinkti atitinkamą Paslaugų planą.
12.3 Mes nei patvirtiname, nei garantuojame, kad Paslaugos bus prieinamos visada, ir Paslaugų prieinamumas gali būti patvirtintas tik patvirtinus jūsų Užsakymą. Informacija apie Paslaugų prieinamumą Svetainėje nėra pateikiama.
12.4 Visa kainodaros informacija, pateikiama Svetainėje, yra teisinga jos paskelbimo metu. Mes pasiliekame teisę bet kuriuo metu keisti kainas, taip pat keisti ar panaikinti specialius pasiūlymus, kai tai būtina.
12.5 Jei kainos pasikeistų laikotarpiu nuo Paslaugų užsakymo pateikimo iki tol, kol mes apdorojame užsakymą ir priimame mokėjimą, bus taikoma kaina, galiojusi Užsakymo pateikimo metu.

13. Užsakymai ir Paslaugų teikimas

13.1 Jokia šios Svetainės dalis nelaikoma sutartiniu pasiūlymu, galinčiu būti priimtu. Jūsų pateiktas užsakymas laikomas sutartiniu pasiūlymu, kurį mes savo nuožiūra galime priimti arba atmesti. Mūsų sutikimas laikomas įvykusiu, kai jums išsiunčiame užsakymo patvirtinimo el. laišką. Tik po to, kai išsiunčiamas užsakymo patvirtinimo el. laiškas, tarp UAB Advansis LT ir jūsų atsiranda teisiškai įpareigojanti sutartis.
13.2 Pagal 13.1 papunktį siunčiamame užsakymo patvirtinimo el. laiške, kuris bus išsiųstas prieš pradedant teikti Paslaugas, bus pateikta ši informacija:
13.2.1 Užsakytų Paslaugų patvirtinimas, įskaitant išsamią informaciją apie pagrindines šių Paslaugų savybes;
13.2.2 Išsamiai išskaidyta užsakytų Paslaugų kaina, įskaitant, kai taikoma, mokesčius, pristatymo ir kitus papildomus mokesčius;
13.2.3 Atitinkami Paslaugų teikimo terminai ir datos;
13.2.4 Naudotojo prisijungimo duomenys ir kita aktuali informacija, reikalinga prieigai prie Paslaugų.
13.3 Jei dėl bet kokių priežasčių nepriimame jūsų užsakymo, įprastomis aplinkybėmis joks mokėjimas nebus nuskaitytas. Bet kuriuo atveju visos jūsų sumokėtos sumos, susijusios su tokiu užsakymu, bus grąžintos per 14 kalendorinių dienų.
13.4 Mokėjimas už Paslaugas bus atliekamas jūsų pasirinktu mokėjimo būdu, kuris gali skirtis:
– nedelsiant – už bet kokį pradinį mokestį arba vienkartinį mokėjimą, susijusį su įsigyta Paslauga arba Paslaugų planu, ir/arba
– prenumerata - tą pačią kiekvieno vėlesnio mėnesio dieną (toliau – atsiskaitymo ciklas) ir (arba) kaip nurodyta jums atsiųstame užsakymo patvirtinime.
13.5 UAB Advansis LT dės visas pagrįstas pastangas teikti Paslaugas rūpestingai ir profesionaliai, laikydamasi geriausios verslo praktikos.
13.6 Tuo atveju, jei suteiktos Paslaugos neatitinka jūsų užsakymo ir todėl yra neteisingos, privalote nedelsdami susisiekti su mumis ir informuoti apie klaidą. Mes užtikrinsime, kad visi reikalingi pataisymai būtų atlikti per penkias (5) darbo dienas.
Tam tikrų Paslaugų teikimui gali būti taikomos papildomos sąlygos. Užsakymo pateikimo metu jūsų bus paprašyta su jomis susipažinti ir patvirtinti savo sutikimą.
13.7 UAB Advansis LT teikia techninę pagalbą per internetinį pagalbos forumą ir (arba) el. paštu. Mes dedame visas įmanomas pastangas atsakyti per pagrįstą laiką, tačiau negarantuojame konkretaus atsakymo termino.

14. Užsakymų ir Paslaugų atšaukimas

Mes siekiame, kad būtumėte visiškai patenkinti Produktais ar Paslaugomis, kurias užsakote iš UAB Advansis LT. Jei norite su mumis pasitarti dėl savo Užsakymo, prašome susisiekti su klientų aptarnavimo komanda el. paštu info@learnmyo.lt arba parašyti mums mūsų adresu (žr. 1 skyrių aukščiau). Jūs turite teisę atšaukti Užsakymą, kurį mes esame priėmę arba nutraukti Sutartį. Jei konkrečioms Paslaugoms taikomos Specialiosios sąlygos numato Paslaugų atšaukimo tvarką, bus taikoma Specialiosiose sąlygose nustatyta atšaukimo politika.
14.1 Jei esate vartotojas, gyvenantis Europos Sąjungoje, jums taikoma įstatyminė „apsisprendimo“ (angl. cooling-off) teisė. Šis laikotarpis prasideda nuo to momento, kai jūsų Užsakymas yra patvirtinamas arba sudaroma sutartis tarp UAB Advansis LT ir jūsų, ir baigiasi praėjus 14 kalendorinių dienų nuo šios datos. Jei per šį laikotarpį pakeičiate savo sprendimą dėl Paslaugų ir norite atšaukti Užsakymą, prašome nedelsiant mus informuoti šiuo el. pašto adresu: info@learnmyo.lt. Jūsų turite teisę atsisakyti Užsakymo per apsisprendimo laikotarpį, o info@learnmyo.lt grąžinti pinigus. 
14.2 Paslaugų atšaukimas pasibaigus 14 kalendorinių dienų apsisprendimo laikotarpiui nesuteikia teisės į bet kokių iki atšaukimo sumokėtų sumų grąžinimą. Jūs patvirtinate ir sutinkate, kad pagal šią Sutartį atliktiems pirkimams po 14 dienų jokios grąžinimo išmokos nėra taikomos, nepriklausomai nuo aplinkybių.
14.3 Prenumeratos užsakymas UAB Advansis LT reikalauja minimalaus vieno mėnesio mokėjimo. Mokėjimai, atlikti už einamąjį atsiskaitymo laikotarpį, nėra grąžinami. Atšaukimo prašymai įsigalioja pasibaigus einamajam mėnesiniam atsiskaitymo laikotarpiui, užtikrinant, kad po to nebūtų taikomi jokie papildomi mokesčiai.

15. Privatumas:

Naudojimąsi Svetaine taip pat reglamentuoja mūsų Privatumo politika (www.learnmyo.lt/privatumo-politika), kuri šia nuoroda yra įtraukiama į šias Naudojimosi sąlygas. Norėdami susipažinti su Privatumo politika, prašome paspausti aukščiau pateiktą nuorodą.

16. Kaip naudojame jūsų asmens duomenis (asmens duomenų apsauga)

16.1 Visa asmeninė informacija, kurią galime rinkti (įskaitant, bet neapsiribojant, jūsų vardą ir adresą), bus renkama, naudojama ir saugoma laikantis Asmens duomenų apsaugos įstatymo (Data Protection Act 1998) nuostatų ir jūsų teisių, numatytų šiame įstatyme.
16.2 Jūsų asmens duomenis galime naudoti šiais tikslais:
16.2.1 teikti jums mūsų Paslaugas;
16.2.2 apdoroti jūsų mokėjimus už Paslaugas; ir
16.2.3 informuoti jus apie naujus mūsų siūlomus produktus ir paslaugas. Jūs galite bet kuriuo metu paprašyti, kad mes nustotume siųsti jums tokią informaciją.
16.3 Tam tikromis aplinkybėmis (pavyzdžiui, jei pageidaujate įsigyti Paslaugas kreditu) ir gavę jūsų sutikimą, galime perduoti jūsų asmens duomenis kredito informacijos agentūroms. Šios agentūros taip pat privalo laikytis Asmens duomenų apsaugos įstatymo (Data Protection Act 1998) nuostatų ir atitinkamai tvarkyti bei saugoti jūsų asmens duomenis.
16.4 Mes neperduosime jūsų asmens duomenų jokiems kitiems tretiesiems asmenims be išankstinio aiškaus jūsų sutikimo.
16.5 UAB Advansis LT nėra skirta saugoti, tvarkyti ar perduoti saugomos sveikatos informacijos (angl. Protected Health Information, PHI), kaip tai apibrėžta Sveikatos draudimo perkeliamumo ir atskaitomybės įstatyme (Health Insurance Portability and Accountability Act – HIPAA) ar kituose panašiuose sveikatos duomenų privatumo teisės aktuose. Naudotojai aiškiai įspėjami neįtraukti, neįkelti ir neperduoti jokių medicininių diagnozių, gydymo pastabų, identifikuojamų sveikatos duomenų ar kitos PHI, žymint ar aprašant programas, įkeliant medžiagą ar naudojantis bet kuria Platformos dalimi. Paslaugos teikiamos tik švietimo ir bendros gerovės tikslais ir nėra profesionalių medicininių konsultacijų, diagnozės ar gydymo pakaitalas.

17. Atsakomybės apribojimai (atsisakymai)

17.1 Mes neteikiame jokių garantijų ar pareiškimų, kad Svetainė atitiks jūsų reikalavimus, bus tinkamos kokybės, tinkama konkrečiam tikslui, nepažeis trečiųjų asmenų teisių, bus suderinama su visomis sistemomis, bus saugi ar kad visa pateikta informacija bus tiksli. Taip pat negarantuojame jokių konkrečių rezultatų, gaunamų naudojantis mūsų Paslauga ar Paslaugomis.
17.2 Jokia šios Svetainės dalis nėra skirta laikyti patarimu, todėl Svetainės Turiniu neturėtų būti remiamasi priimant sprendimus ar atliekant bet kokius veiksmus.
17.3 Nors dedame pagrįstas pastangas užtikrinti, kad Svetainė būtų saugi ir joje nebūtų klaidų, virusų ar kenkėjiškų programų, jūs esate primygtinai raginami patys prisiimti atsakomybę už savo interneto saugumą, asmens duomenų apsaugą ir savo kompiuterių saugumą.

18. Taisyklių ir sąlygų pakeitimai

Mes pasiliekame teisę bet kuriuo metu keisti Svetainę, jos Turinį ar šias Naudojimosi sąlygas. Bet kokie Naudojimosi sąlygų pakeitimai taps jums privalomi nuo pirmojo naudojimosi Svetaine po tokių pakeitimų įsigaliojimo. Jei pagal teisės aktus privalėsime atlikti šių Naudojimosi sąlygų pakeitimus, tokie pakeitimai automatiškai bus taikomi tiek visiems tuo metu laukiantiems užsakymams, tiek ir visiems jūsų ateityje pateiktiems užsakymams.

19. Svetainės prieinamumas

19.1 Svetainė teikiama principu „tokia, kokia yra“ (angl. as is) ir „kaip prieinama“ (angl. as available). UAB Advansis LT taiko geriausią praktiką siekdama užtikrinti aukštą Svetainės pasiekiamumą (angl. uptime), įskaitant gedimams atsparią architektūrą, talpinamą debesijos serveriuose. Tačiau mes nesuteikiame jokių garantijų, kad Svetainė ar Priemonės bus be trūkumų ir (arba) gedimų, ir neteikiame jokio pobūdžio kompensacijų ar grąžinimų už veiklos sutrikimus ar neprieinamumą. Taip pat neteikiame jokių aiškių ar numanomų garantijų dėl tinkamumo konkrečiam tikslui, informacijos tikslumo, suderinamumo ar patenkinamos kokybės.
19.2 Mes neprisiimame jokios atsakomybės už bet kokius Svetainės veikimo sutrikimus ar neprieinamumą, atsiradusius dėl išorinių priežasčių, įskaitant, bet neapsiribojant, interneto paslaugų teikėjų (ISP) įrangos gedimus, serverių prieglobos įrangos gedimus, ryšių tinklų sutrikimus, elektros energijos tiekimo sutrikimus, gamtinius reiškinius, karo veiksmus ar teisės aktų nustatytus apribojimus bei cenzūrą.

20. Atsakomybės apribojimas

20.1 Tiek, kiek tai leidžiama pagal galiojančius teisės aktus, mes neprisiimame jokios atsakomybės už bet kokius tiesioginius ar netiesioginius nuostolius ar žalą, numatomus ar nenumatomus, įskaitant bet kokią netiesioginę, pasekminę, specialią ar atsitikintinę žalą, kylančią dėl naudojimosi Svetaine ar joje pateikta informacija. Jūs turite žinoti, kad naudojatės Svetaine ir jos Turiniu savo pačių rizika.
20.2 Niekas šiose Naudojimosi sąlygose neatmeta ir neriboja UAB Advansis LT atsakomybės už mirtį ar asmens sužalojimą, atsiradusius dėl UAB Advansis LT aplaidumo.
20.3 Niekas šiose Naudojimosi sąlygose neatmeta ir neriboja UAB Advansis LT atsakomybės už bet kokius tiesioginius ar netiesioginius nuostolius ar žalą, atsiradusius dėl netinkamo Paslaugų suteikimo arba dėl pasikliovimo neteisinga Svetaine pateikta informacija.
20.4 Jei kuri nors šių Naudojimosi sąlygų nuostata būtų pripažinta neteisėta, negaliojančia ar kitaip neįgyvendinama, tokia nuostata laikoma atskirta nuo šių Naudojimosi sąlygų ir neturi įtakos likusių Naudojimosi sąlygų galiojimui bei įgyvendinamumui. Ši nuostata taikoma tik tose jurisdikcijose, kuriose atitinkama sąlyga yra neteisėta.

21. Teisių neatsisakymas:

Tuo atveju, jei kuri nors šių Naudojimosi sąlygų šalis nepasinaudoja bet kuria čia numatyta teise ar teisių gynimo priemone, tai nelaikoma tokios teisės ar teisių gynimo priemonės atsisakymu.

22. Ankstesnės naudojimosi sąlygos

Jei kiltų bet koks prieštaravimas tarp šių Naudojimosi sąlygų ir bet kurių ankstesnių jų versijų, pirmenybė teikiama šioms Naudojimosi sąlygoms, nebent aiškiai nurodyta kitaip.

23. Trečiųjų šalių teisės

Niekas šiose Naudojimosi sąlygose nesuteikia jokių teisių tretiesiems asmenims. Pagal šias Naudojimosi sąlygas sudaroma sutartis yra sudaroma tik tarp jūsų ir UAB Advansis LT.

24. Pranešimai ir komunikacija

24.1 Visi pranešimai ir (arba) komunikacija mums turi būti teikiami raštu – paštu, siunčiant į mūsų buveinės adresą (žr. aukščiau), arba el. paštu info@learnmyo.lt. Toks pranešimas laikomas gautu:
– praėjus 7 dienoms nuo išsiuntimo, jei siunčiamas pirmos klasės paštu;
– išsiuntimo dieną, jei el. laiškas gautas pilnai darbo dieną;
– kitą darbo dieną, jei el. laiškas išsiųstas savaitgalį ar valstybinę švenčių dieną.
24.2 Kartais, jei esate pasirinkę gauti tokią informaciją, galime jums siųsti pranešimus apie mūsų produktus ir (arba) paslaugas. Jei nebenorite gauti tokios informacijos, prašome paspausti nuorodą „Atsisakyti prenumeratos“ (Unsubscribe) bet kuriame iš mūsų gautų el. laiškų.

25. Taikytina teisė ir jurisdikcija

Šias Naudojimosi sąlygas ir santykius tarp jūsų ir UAB Advansis LT reglamentuoja ir jos aiškinamos pagal Lietuvos Respublikos teisę, ir jūs sutinkate paklusti išimtinei Lietuvos Respublikos teismų jurisdikcijai.
